Terms and Conditions

Usage of website

These terms and conditions apply to the use of this website and to the trade of products from The Catman Limited ("we", "our", "us", "The Catman" or "The Catman Limited") to the customer ("you" or "your").  By viewing and using this website you shall be deemed to accept these terms and conditions without any qualification whatsoever.  If you do not accept these terms and conditions you must stop using this website immediately.

We reserve the right to amend or withdraw, temporarily or permanently, this website (or any part thereof), with or without notice to you and you confirm that we shall not be liable to you or any third party for any amendment to or withdrawal of the website.

It is your responsibility to check the terms and conditions regularly for revisions and updates.  You are bound by any such revisions and should therefore from time to time visit this page to review the current terms and conditions.  If you still continue to use this website after we post changes to the terms and conditions, this will indicate your acceptance of any such changes.  If you do not agree to the changes made to the terms and conditions, then you must stop using this website immediately.

Acceptance of your order

Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order.  This email is not an acceptance of your order.

Unless you cancel your order in accordance with our Cancellation Policy below, acceptance of your order and completion of the contract between you and The Catman will take place at the time of dispatch of the products ordered by you.  The sales contract is concluded in New Zealand only and the language of the contract is English.

We reserve the right not to accept your order, or part of your order, in the event that, for example:

  • We are unable to obtain authorisation for payment by credit card; or
  • The product you ordered is out of stock; or
  • You are not eligible to order from The Catman Limited.

If there is any problem with your order, we will contact you.

We reserve the exclusive right to accept or reject (for any reason) whatsoever and in whole or part, any order submitted by you.  If we reject your order (or part of your order), any money paid by you in relation to the rejected part of that order, shall be refunded and we shall have no liability to you in relation to the rejected part of your order.

Stock Availability

All orders are subject to acceptance and availability of products.  We do our best to keep all products in stock, however, some products sell out faster than anticipated and there can be long lead times from suppliers.  If for any reason a product is not available, we will endeavour to notify the non-availability on this website, displaying a "Sold Out" sign next to the product.  Please be aware that even if the product is in your shopping bag, it is not reserved and can be bought by another customer while you are still browsing.

If an item is sold out you can chose to be notified when the product is back in stock by clicking on - notify me - next to the product.  We will then notify you as soon as we receive the new stock, allowing you to place an order for the product by you using the online shop. 

We may revise the range of products or the specifications of any product at any time and without notice to you.

Cancellation Policy

If you change your mind about an order that you have placed with us, you must contact us within 24 hours of placement of your order by emailing us online.

Orders are usually processed immediately after you place the order, so we may have already packaged your order and made arrangements for it to be sent to you when you cancel it.  If this is the case, we cannot always stop the order from being sent.  If the order has already been sent, then you will be charged for the delivery charges.  Once you receive the order you must return it to us in its original condition and packaging with tags attached, at your own cost.

Product Descriptions

All products are sold subject to their product description.  We take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct.  Please note that due to the constraints of digital reproduction the colours shown on the website may vary slightly from the product colour and from screen to screen.

Trading Names and Copyright

The Catman Limited is registered in New Zealand under Company Number 2192701.  Our registered office is located in Christchurch.  Our GST number is 101-300-838.

Any copyright or other intellectual property rights in the photographs, site design and graphics, brands, logos and products shown on this website, shall be and remain the absolute property of The Catman Limited or its suppliers, whichever the case may be.  You are permitted access to this website for personal, non-commercial use only.  You may not use, distribute, transmit, store or reproduce any part of this website for commercial use without the prior written permission from The Catman Limited.


You agree fully to indemnify, defend and hold us and our directors, employees, agents and suppliers, harmless immediately on demand from and against all claims, liability, injury, damages, losses, costs, charges, outgoing payment or expenses, including reasonable legal (solicitors/client costs) fees, arising out of any breach of the conditions by you or any other liabilities, arising out of your use of this website or the use by any other person accessing the website using your shopping account and your personal information.

Warranties and Limitation of Liability

We will pass on to you the benefit of any manufacture warranty, however all terms, conditions and warranties (whether express or implied) whether by us or our agents, statute or otherwise (other than those mandatory warranties in the Fair Trading Act 1986 and Sale of Goods Act 1908 or other similar legislation) are expressly excluded.

You acknowledge that if you are a consumer under the Consumer Guarantees Act 1993 but are acquiring the products for business purposes, the guarantees under the Consumer Guarantees Act 1993 do not apply.

We and any of our directors, employees or agents, shall not be liable (whether in contract, tort or otherwise) for any loss (whether direct, indirect, consequential or economic) injury, claim, action, liability, cost, charge, expense, outgoing payment or damage of any kind whatsoever arising out of the supply of, or failure to supply, products.

If we or any director, employee or agents are found to be liable to you in any circumstance then the maximum combined amount such person shall be liable for to you is an amount equal to the lesser of:

a)  The purchase price paid for the product; or
b)  The cost of replacement or repair of any product; or
c)  The actual loss or damage suffered.

Governing Law

The terms and conditions together with all our policies and procedures will be governed by and construed in accordance with the laws of New Zealand and you irrevocably submit to the exclusive jurisdiction of the laws of New Zealand.


The price payable by you for products ordered by you shall be the price quoted on this website at the time your order is submitted, together with the applicable delivery charges (which are payable in addition to the price of the products and any other moneys payable pursuant to these terms and conditions.  All prices include New Zealand Goods and Services Tax (GST) where applicable.  We reserve the right to vary any price on this website at any time and without notice to you.

Payment methods

The Catman Limited accepts the following payment method:

Credit card - Visa and Mastercard only

All payments made by credit card are processed through DPS/Westpac payment system.  All credit card holders are subject to validation checks and authorisation by the card issuer when you place your order.  If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.  Credit card payments will be debited and cleared from your account upon receipt of your order by The Catman Limited.  You confirm that the credit card that is being used is yours.  We do not store your credit card details.

Please note that we may contact you for proof of identity in the case of large orders.


Once we have confirmed our acceptance of your order, we will endeavour to dispatch your order within 5 to 7 business days.  If we currently hold the stock you are ordering then the dispatch will be by courier the same day as the order is received. 

We do not deliver to Post Office Boxes or Private Bag addresses.  To ensure a prompt delivery we recommend that you use your work address if you are not going to be home during normal working hours.

You may specify delivery instructions for your order (for example you may authorise the courier to leave the products in a specified location if you will not be at the delivery address).  We shall not be liable for any order that is delivered in accordance with your delivery instructions.

We will endeavour to meet delivery times wherever possible however we will not be liable for any loss, expense or other damage whether direct or indirect caused by a delay in delivery.


Orders are covered in transit by the courier company.

Once the package is delivered to you by the courier (i.e. your signature for delivery is obtained or the products are left in accordance with your delivery instructions), you assume full responsibility for and risk of the products.

Each order can only be sent to one delivery address.  If you wish to buy products for two different recipients then you will be required to place separate orders for each delivery address you wish to ship to.

Delivery Charges

A delivery charge will be added onto your purchase.  Delivery charges include without limitation, postage, insurance, packaging and handling costs. 

Privacy and Security

Your privacy and security are extremely important to us here at The Catman Limited.  We treat all your personal information as confidential and we will only use it for the following purposes:

To process your order and inform you of its delivery

To contact you to accept your order or to confirm your payment details if necessary

To statistically analyse site usage and products purchased

To statistically improve this website and its services to you

To improve the shopping experience and customer satisfaction

To notify you of products that may be of interest to you

To enforce our rights in the event of default by you

We will only record your email address and other personal information when you purchase a product from us.

Secure Online Ordering

We take all reasonable care to ensure that the personal information that you share with us is safe and secure.

All credit card transactions on this website are processed by DPS/Westpac a secure online payment gateway that encrypts your credit card details in a secure environment.  We do not hold your credit card details on our website or on our customer database.

To help ensure that your shopping experience is safe, simple and secure when using your credit card for payment, The Catman Limited uses Secure Socket Layer (SSL) technology.  If your browser is SSL capable, your data will be automatically encrypted and protected before it is sent over the internet to us.

We will take all reasonable care to keep the details of your order and payment secure however we make no warranty in respect to the strength and effect of the encryption of data and we shall not be held liable for any direct or indirect loss or damage you may suffer from events arising from misuse or unauthorised access to or use of any data you provide when accessing or ordering from this website.

Changes to the Privacy Policy

We reserve the right at our discretion, to alter this Privacy Policy at any time.  It is your responsibility to check the Privacy Policy regularly for revisions and updates.  Any changes to this Privacy Policy will take effect immediately once they are published on this website.  If you still continue to use this website or if you provide any personal information after we post changes to this Privacy Policy, this will indicate your acceptance of any such changes.
Returns and Refunds Policy

All purchased products can be returned provided that you must notify us of your intention to return or exchange a product within 24 hours of delivery.  We require that the product is returned to us within 7 days of the date of your notification in its original condition and packaging with all tags attached.  Products returned outside the above time frames may be accepted at the sole discretion of The Catman Limited.

Refunds and Exchanges

The Catman will be happy to refund or exchange a product provided it is in perfect condition and in its original packaging with all tags attached.  Delivery charges are not refundable.

Please note that refunds for products bought as gifts can only be given to the original buyer and we cannot stop the original buyer from knowing.

The Catman will not accept returns for any non-faulty products that have been worn or used and where the tags have been removed.

Please note, exchanges are subject to product availability.  We can only exchange a product for the same product in a different size and/or colour, subject to availability.  We are unable to process any exchanges for a completely different product.

Exchanged products can only be dispatched after the returned product has been received and undergone a quality control check.

Returned products are your responsibility until they reach us, including delivery charges and insurance.  We shall not be responsible for misdirected shipments or products lost or damaged in transit.

In the unlikely event that you have received a damaged or faulty product you may return it to us within 14 days of delivery provided it is in its original packaging with all tags attached.  Likewise if you have received an incorrect product you may return it to us within 14 days provided it is in perfect condition and in its original packaging with all rags attached.  We will exchange and resend the correct product free of additional delivery charges, subject to availability, once we receive the returned product.  If the correct product is no longer available, then we will issue a refund.

Returns Procedure

To make a return please first contact us by email online.  Please state in your email that you wish to return your product and the reason why.

Secondly please fill in the return form (we will email this to you and this will include the address to sent the goods to) and include it with the product in its original condition and packaging, with all tags attached.  Please wrap the product carefully so as to avoid damage during transit and be sure to include your name, address and a daytime telephone number on the form.  If you are returning a gift, please remember to include the buyer's name and contact details.
